Shropshire Council Local Plan Supplementary Planning Documents Consultation

 Following Cabinet approval (10th Feb 2016) Shropshire Council will, today, publish for consultation three draft Supplementary Planning Documents (SPD) between 18 March 2016 and 5pm on 29 April 2016. The SPDs provide more detailed advice and guidance on the policies included in the Local Plan (the adopted Core Strategy and SAMDev Plan). The draft SPDs cover issues relating to: the Type and Affordability of Housing, the Natural Environment and the Historic Environment.

 

What is being consulted on?

·         Draft Type and Affordability of Housing SPD – guidance for the  implementation of housing policies relating to the type, mix and design of housing, affordable housing contributions and exception sites, agricultural workers dwellings, houses in multiple occupation and Gypsy and Traveller accommodation;

·         Draft Natural Environment SPD – guidance for the implementation of policies to protect, conserve and enhance the natural environment. Guidance is provided on: assessing the effects of development proposals on Shropshire’s natural assets; the type of information needed to support a planning application to ensure significant adverse effects are avoided, mitigated, or compensated for; background to the interaction between nationally and internationally protected areas, sites, species, features and the planning system.

·         Draft Historic Environment SPD - guidance that expands upon and explains historic environment policies.  Guidance is provided on how to assess the effects of proposed developments on heritage assets; background on both designated and non-designated assets and what to do if harm is likely to cause an adverse effect on the significance of a heritage asset(s).

Shropshire Council: Site Allocations and Management of Development (SAMDev) Plan: Adoption Statement 

Notice of adoption of the SAMDev Plan – December 2015

 

In accordance with Regulation 26 of the Town and Country Planning (Local Planning) (England) Regulations 2012, notice is given that Shropshire Council formally adopted its SAMDev Plan on 17 December 2015

 

The SAMDev Plan covers the administrative County of Shropshire (excluding the Borough of Telford and Wrekin) and sets out proposals for the use of land and policies to guide future development in order to help to deliver the Vision and Objectives of the adopted Core Strategy for the period up to 2026. Together with the Core Strategy, the SAMDev Plan forms the Council’s Local Plan.

 

The SAMDev Plan has been subject to an Examination in Public by an independent Planning Inspector appointed by the Secretary of State.  The adopted Plan incorporates the recommendations set out in the Planning Inspector’s Report and accompanying appendix.

 

The adopted SAMDev Plan, Sustainability Appraisal and the Inspector’s Report with accompanying appendices and this Adoption Statement are available to view on the Council’s website: http://shropshire.gov.uk/planning-policy and paper copies of the Plan documents will be available for inspection during normal opening hours at our principal office:

Copies of the accompanying Policies Maps are available to view on the Council’s website and paper copies will be made available at locations above as soon as reasonably practicable in January 2016.

planning.policy@shropshire.gov.uk Any person aggrieved by the SAMDev Plan may apply to the High Court under Section 113 of the Planning and Compulsory Purchase Act 2004 (as amended) for leave to challenge the validity of the Plan on the grounds that:

·         The document is not within the appropriate power;

·        A procedural requirement has not been complied with.

Any such application for leave must be made before the end of the period of six weeks beginning with the day after the date of the adoption of the Plan, which is 17th December 2015

SAMDev 

Consultation on Revised Plan 

The Site Allocations and Management of Development (SAMDev) Plan Schedule of Main Modifications is being published for a six week consultation period from Monday 1 June until 5pm Monday 13 July 2015.
The Inspector is now inviting comments on the Main Modifications as part of the examination into the Shropshire Council SAMDev Plan. The Main Modifications have been identified by the Inspector as those necessary to make the policies in the SAMDev Plan sound.  The Inspector will take account of all representations received relating to the modifications before finalising her report to the Council.

Representations must be made to the Programme Officer and received by 5pm on Monday 13 July 2015. Representations received after this time will not be accepted or considered by the Inspector.

Comments will only be accepted and considered by the Inspector that relate to a proposed Main Modification.

Shropshire Council is currently developing its Site Allocation and Management of Development (SAMDev) plans for the county, which will define where housing development will be located in Shropshire up to 2026. Communities have the option to remain as “open countryside” where no open market housing is permitted or opt in to become either a “hub” or “cluster” settlement where development of open market housing will be permitted.

As a rural village with services such as a school, community shop and village hall Lydbury North Parish Council have opted to be a “hub” settlement and
have asked Shropshire Council to explore the potential for development on sites in the village of Lydbury North for up to 20 properties.

The publishing of the Parish Plan in 2008  was the starting point of this process.

Housing Survey Results

To help the Parish Council and Shropshire Council learn more about the housing needs of the

community a Housing needs survey has been carried out. A questionnaire was sent to all 281

households on the electoral roll, and 94 forms were returned (33% response rate).

The results of the survey will be used to inform Lydbury North Parish Council of the views of local
people and help form the basis of further consultation carried out by Shropshire Council in the summer of 2013.

The SAMDev Plan Pre-Submission Draft, Submission Policies Map, Sustainability Appraisal, Consultation Statement and addendum, Schedule of Proposed Minor Changes, representations received, Summary of the Main Issues Raised in the representations and submitted evidence base can be viewed on our website via: www.shropshire.gov.uk/samdev from midday on Friday 22 August 2014.

Examination of the SAMDev Plan 

Inspector Claire Sherratt DIP URP MRTPI has been appointed to conduct the examination to determine whether the SAMDev Plan is sound. 

The examination is a continuous process running from submission through to the receipt of the Inspectors report. Part of the process will involve hearing sessions where those invited to attend, will have the opportunity to respond to matters raised by the Inspector. Once information on the hearing sessions is confirmed, all details relating to the examination process will be advertised, made available online and sent to all respondents.
